TERMS AND CONDITIONS
1. GENERAL
By accessing the Dodo Sushi and Rolls website and placing an order, you agree to comply with and be bound by these Terms and Conditions. These terms apply to all users and customers of our services in Pattaya.
2. ORDERING AND CONTRACT FORMATION
- Order Acceptance: An order is an offer to buy from us. A contract is formed only when we send you a formal confirmation.
- Menu Accuracy: We strive for accuracy in descriptions and images. However, we reserve the right to substitute ingredients of equal quality if necessary.
- Minimum Order: We set minimum order values based on delivery zones. We reserve the right to refuse orders that do not meet these requirements.
3. PRICING AND PAYMENT
- Currency: All prices are in Thai Baht (THB) and include applicable taxes (VAT).
- Payment Methods: We offer online payment options including PromptPay and Credit/Debit Cards. Depending on the selected payment method, payments may be processed by our authorized payment service providers, including Omise (Opn). We do not store or process full credit/debit card details on our servers.
- Cash on Delivery (COD): Availability of COD is subject to the restaurant's discretion and may depend on order history, delivery zone, or participation in our loyalty program.
- Loyalty Perks: Payment terms and delivery fees may be adjusted for members of our loyalty program.
4. DELIVERY CONDITIONS
- Zones and Fees: We deliver within specific zones in Pattaya. Each zone has a designated minimum order amount and a delivery fee. Fees may be waived or reduced based on order volume, specific zones, or loyalty status.
- Estimated Times: Delivery times are estimates. We are not liable for delays caused by traffic, weather, or other circumstances beyond our control in Pattaya.
- Customer Responsibility: The customer must provide a correct address and a working phone number. If we cannot reach you within 30 minutes of the scheduled delivery time, the order will be cancelled. In such cases, no refund will be issued for prepaid orders, and the order will be marked as a failed delivery.
5. CANCELLATIONS AND REFUNDS
- On-Demand Orders: Once an order for immediate preparation is placed, it cannot be cancelled, as we begin sourcing and preparing fresh ingredients immediately.
- Pre-Orders: Orders scheduled for a future date can only be cancelled or modified if the request is made at least 24 hours (1 day) prior to the scheduled delivery date.
Refund Policy: Refunds or replacements are only provided if the order is incorrect (wrong items delivered). Reporting Issues: Discrepancies must be reported immediately upon receipt of the order with photographic evidence.
- Refund Processing: Approved refunds will be processed back to the original payment method, where supported. The time required for the refunded amount to appear may vary depending on the payment method, card issuer, or bank.
- Payment Disputes: If you notice any unauthorized charge or discrepancy on your statement, please contact us immediately at [email protected] before initiating a formal dispute with your bank.
6. ALCOHOL SALES & CATERING
In accordance with Thai law, alcohol is only sold/served to individuals over 20 years of age during permitted hours. For catering services, where alcohol is part of a broader service package, all statutory age restrictions and service regulations still apply. We reserve the right to request a valid ID upon delivery or service.
7. LIMITATION OF LIABILITY & ALLERGENS
7.1 General Limitation
To the maximum extent permitted by Thai law, Dodo Sushi and Rolls shall not be liable for any indirect or consequential damages arising from the use of our website or online ordering system. Nothing in this policy shall exclude or limit liability for personal injury, food safety violations, or damages caused by proven gross negligence where such liability cannot be excluded under the laws of the Kingdom of Thailand.
7.2 Allergen Disclosure
Our menu provides descriptions of ingredients. It is the sole responsibility of the customer to review these descriptions. If you have any food allergies, you must not place an order without prior consultation with our staff. By placing an order, you confirm that you have vetted the ingredients.
7.3 Cross-Contamination
Our kitchen handles fish, shellfish, soy, sesame, eggs, nuts, and wheat. We cannot guarantee an allergen-free environment. Individuals with severe allergies should refrain from ordering.
7.4 Right to Refuse Service
We reserve the right to refuse or cancel any order if we determine that we cannot safely meet a customer’s specific dietary requirements.
8. GOVERNING LAW
These Terms and Conditions are governed by the laws of the Kingdom of Thailand. Any disputes shall be subject to the exclusive jurisdiction of the Thai courts.
